  1. The promoter is: Sports Media and Entertainment 360 Pty Ltd whose registered office is at Level 1, 327 Bay Street Brighton, Victoria, 3186. No sponsor or event partner is in any way involved in the management or conduct of this competition.
  2. Employees of Sports Media and Entertainment 360 Pty Ltd or their family members or anyone else connected with the promoter in an official capacity with the organising, set up or running of the ‘Refer 5 Friends and Have a Chance to Win a Draw’ competition to be drawn at the Carman’s Women’s Fun Run 2016 Event at Catani Gardens, St Kilda VIC (the ‘Event’) (the ‘Competition’) shall not be permitted to enter the Competition.
  3. Closing date for entry will be Friday 18 November 2016 at 5pm AEDT (‘Closing Date’). After this date no further entries to the Competition will be permitted. There will be staggered announcements of car key recipients leading up to the closing date as outlined below..
  4. No responsibility can be accepted for entries not received by the Closing Date for whatever reason.
  5. The rules of the Competition and the prize for each winner are as follows:
  6. There will be a total of 200 virtual keys available, split over several categories as outlined below. Each recipient of one of the 200 virtual keys drawn and distributed will receive a virtual key over email with a number assigned to their key. It is the responsibility of the virtual key recipient to report to the staging area located in the Sponsor Marquee row at the Event prior to 9am on Sunday 4 December 2016 and place their unique number (virtual key) into a barrel. Any recipient that does not report to the staging area located in the Sponsor Marquee row at the Event by 9am will forfeit their position in the Competition, and no replacement virtual key will be awarded. The individual will have their virtual key number marked off by a supervising marshal on placement into the barrel. The winner of the Competition will then be drawn from the barrel at approximately 11am on Sunday 4 December 2016 at the staging area at the Event (the ‘Final Draw’). All entrants into the Competition must be 18 years or older as at time of entry and must be entrants in the Carman’s Women’s Fun Run Event 2016 (‘the Event’).
  7. Top 100 fundraisers (100 keys)
    To be eligible for this component, individuals must register to fundraise for the event through the registration portal that is accessible by clicking ‘Enter Now’ on the www.carmanswomensfunrun.com.au website (the ‘website’) and electing to fundraise as part of their event entry. Fundraising undertaken by individuals will only be recognized if it has taken place through the event’s official fundraising platform, Everyday Hero, and must be wholly attributable to the individual’s Carman’s Women’s Fun Run 2016 fundraising profile. One hundred (100) virtual keys will be awarded to the one hundred (100) individuals who have raised the most funds through their individual fundraising profile as of 5pm, November 18 2016.
  8. SME360 Entry Referral Competition (100 keys)
    To be eligible for this component, the individual must register themselves for the Event through the entry portal on the Website, located behind the ‘Enter Now’ button on http://www.carmanswomensfunrun.com.au. This individual must then refer at least five friends, who in registering themselves for the Event must enter the name of the referrer in the designated area within the registration portal. A total of one hundred (100) virtual keys will be available for this component of the Competition. All individuals who enter and successfully refer five friends, who enter and acknowledge the referrer in the registration process, will go in the draw to receive a key. (‘SME360 Initial Selection Draw’).
  9. The promoter reserves the right to cancel or amend the Competition and these terms and conditions in the Event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other Event outside of the promoter’s control. Any changes to the Competition will be notified to all Event entrants as soon as possible by the promoter.
  10. The promoter is not responsible for inaccurate Competition or prize details supplied to any entrant by any third party connected with this Competition.
  11. The prize drawn as part of this promotion will be a Fiat 500 vehicle (ex-factory demo), valued at $19,500 RRP (price as at 8 August 2016). No cash alternative to the prizes will be offered. The prize is not transferable. The Prize is subject to availability and we reserve the right to substitute any prize with another of equivalent or greater value. The recipient may not have any choice in regards to details of the car, including but not limited to transmission, colour, style and interior detail. (to be confirmed on confirmation of car prize)
  12. The recipients of the 100 virtual keys for the SME360 Initial Selection Draw will be drawn at random and the top 100 Top Fundraisers as of November 18 will each be awarded a virtual key. Entrants and/or fundraisers are only eligible to receive one virtual key each.
  13. The virtual key recipient will be notified in writing within 10 days of the initial drawing of the keys for the Team Pink Lady Top Fundraisers  and SME360 Initial Selection Draw. If the recipient cannot be contacted or does not claim the key within 5 days of such notification, the promoter reserves the right to withdraw the key from the key recipient and draw a replacement recipient.
  14. Should the winner of the Competition drawn on Sunday 4 December 2016 not be present at the Final Draw at the Event, the promoter will notify the winner in writing within 48 hours of the Final Draw following the Event. Should the winner not acknowledge acceptance of the prize by 5pm Monday 12th December 2016 AEDT, the promoter reserves the right to withdraw the prize from the winner and draw a replacement recipient.
  15. The promoter will notify the winner of the Competition when and where the prize can be collected. The prize will be transferred to the winner within 28 days after the draw, unless availability of the vehicle creates a time delay in which case the winner will be notified in writing of the date of transfer.
  16. The promoter’s decision in respect of all matters to do with the Competition will be final and no correspondence will be entered into.
  17. By entering this Competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.
  18. The Competition and these terms and conditions will be governed by Australian law and any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
  19. The winner agrees to the use of her name and image in any publicity material relating to the Event and/or the Competition. The winner’s name will be published on the Website. Any personal data relating to the winner or any other entrants in the Competition will be used solely in accordance with the Privacy and Data Protection Act 2014 (VIC) (‘Privacy and Data Act’) or other current privacy and data legislation if the Privacy and Data Act is repealed and will not be disclosed to a third party without the entrant’s prior consent.
  20. All currency noted in these terms and conditions are in Australian Dollars.
  21. Neither the promotor and its employees or agents will be liable to any entrant in the Competition or any third party for any misadventure, accident, injury, loss or damages however caused, or for personal injury or death or loss of, or damage to property or claim (except to the extent such liability cannot be excluded by law) that may occur:

(a) in connection with the Competition, the Event or any prize;

(b) due to the broadcast of any program relating to the Competition or the Event or the publication of any material, including any statements made by any person in connection with the Competition or the Event;

(c) arising from or related to any problem or technical malfunction of any internet communication network related to or resulting from participation in the Competition or the Event.
